Every project is delivered according to a mutually agreed proposal, quotation, Statement of Work (SOW), or service agreement.

Acceptance of Services

By confirming a quotation, proposal, purchase order, invoice, or written agreement, you acknowledge that you have read, understood, and accepted these Terms & Conditions.

These Terms apply to all clients, businesses, website visitors, and users of our services.

Scope of Services

Services will be delivered strictly in accordance with the approved proposal or agreement.

Any request outside the approved scope will be treated as additional work and may require:

A revised quotation
Additional timeline
Separate approval
Additional payment

No additional work will begin without mutual agreement.

Project schedules depend on:

Delays caused by missing information or late approvals may extend project timelines without liability to We Grow Multimedia.

Client Responsibilities

To ensure successful project delivery, clients agree to:

Submit required content and assets on time
Respond to approval requests promptly
Designate a primary point of contact
Review deliverables within agreed timelines

Failure to provide necessary information may result in project delays.

Pricing & Payments

Project pricing, milestones, and payment schedules are specified within the approved quotation or agreement.

Unless otherwise agreed:

Advance payments are required before work begins.
Milestone payments must be made according to the agreed schedule.
Final deliverables may be withheld until outstanding balances are cleared.

All prices are exclusive of applicable taxes unless specifically stated.

Refund Policy

Payments made for:

Design
Development
Marketing
Production
Campaign Setup

are generally non-refundable once work has commenced.

Refund requests, if applicable, will be evaluated solely at the discretion of We Grow Multimedia and only under exceptional circumstances.

Late Payments

Invoices must be paid within the agreed payment period.

Delayed payments may result in:

Temporary suspension of services
Delay in project delivery
Suspension of advertising campaigns
Suspension of website maintenance
Delay in handover of deliverables

Services may resume once outstanding payments have been received.

Revisions

Each project includes the number of revisions specified in the proposal.

Additional revisions beyond the agreed limit may incur additional charges.

Major design or strategy changes after approval may be considered a new scope of work.

Intellectual Property

Unless otherwise agreed in writing:

All concepts, strategies, designs, graphics, videos, websites, campaigns, code, documentation, and creative assets remain the intellectual property of We Grow Multimedia until full payment has been received.
Upon receipt of full payment, ownership of the final approved deliverables transfers to the client, except for third-party licensed assets, stock content, fonts, software, and proprietary tools.

We Grow Multimedia retains the right to display completed work in its portfolio, marketing materials, and case studies unless restricted by a separate written confidentiality agreement.

Confidentiality

Both parties agree to maintain strict confidentiality regarding:

Business strategies
Financial information
Marketing plans
Customer information
Internal processes
Proprietary materials
Project documentation

Confidential information will not be disclosed to third parties except where legally required or with written permission.

Data Protection

We Grow Multimedia handles client information responsibly and follows industry-standard security practices to protect confidential data.

While reasonable safeguards are implemented, no online system can guarantee absolute security. Clients acknowledge the inherent risks associated with internet-based communications and digital platforms.

Performance Disclaimer

Digital marketing outcomes depend on numerous external factors beyond our direct control.

Although we apply proven strategies and industry best practices, we do not guarantee:

First-page Google rankings
Specific keyword positions
Lead volume
Sales figures
Revenue growth
Return on Ad Spend (ROAS)
Social media reach
Website traffic
Conversion rates

Performance may vary based on market conditions, competition, advertising budgets, customer behaviour, algorithm changes, and client implementation.

Third-Party Platforms

Our services may involve platforms operated by third parties, including:

WordPress
Shopify
Hosting Providers
CRM Platforms
Email Marketing Software

We Grow Multimedia is not responsible for service interruptions, policy changes, algorithm updates, account suspensions, or technical issues arising from these third-party platforms.

Communication

We are committed to maintaining clear and professional communication throughout every project.

Our standard response time is typically within 24–48 business hours, excluding weekends and public holidays.

Project updates, approvals, and important decisions should be communicated through mutually agreed communication channels.

Suspension of Services

We reserve the right to suspend services if:

Payments remain overdue
Requested information is repeatedly withheld
Abusive, unlawful, or unethical behaviour occurs
Clients misuse our work or intellectual property
Contractual obligations are breached

Suspension does not waive any outstanding payment obligations.

Termination

Either party may terminate the engagement by providing written notice in accordance with the signed agreement.

Upon termination:

Work completed up to the termination date will be invoiced.
Outstanding invoices become immediately payable.
Any approved third-party expenses remain payable by the client.
Deliverables completed before termination will be released only after payment clearance.

Both parties agree to make reasonable efforts to resolve concerns before terminating the relationship.

Limitation of Liability

To the maximum extent permitted under applicable law, We Grow Multimedia shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, business interruption, data loss, or reputational harm arising from the use of our services.

Our total liability shall not exceed the amount paid by the client for the specific service giving rise to the claim.

Force Majeure

Neither party shall be held liable for delays or failure to perform obligations caused by circumstances beyond reasonable control, including natural disasters, pandemics, government restrictions, cyber incidents, labour disputes, power failures, internet outages, or other unforeseen events.

Governing Law & Jurisdiction

These Terms & Conditions are governed by the laws of the Republic of India.

Any dispute arising from these Terms shall first be addressed through good-faith negotiation and mediation.

If a resolution cannot be reached, the matter shall be subject to the exclusive jurisdiction of the competent courts in Mumbai, Maharashtra, India.

Changes to These Terms

We Grow Multimedia reserves the right to modify or update these Terms & Conditions at any time.
